1099 on Short Sale Transaction

A while ago I have posted a blog in reference of doing short sale with Bank of America (“Short Sale with Bank of America....again”). In result person in charge who did take a look at my file contacted me and I have successfully closed 30 days later. So, I thought that is it. Transaction closed, paperwork filed away.

But no, not so fast…Last week, I have received a phone call from my concerned Seller trying to file the taxes. My client, advised by his CPA, needs 1099 form that should be furnished by Bank of America. The COE occurred on 12/21/2009. The closing date that Bank of America has in a system shows 01/04/10, and based on that, 1099 will be sent in 2011.

I emailed back and forth to the negotiator the copy of city tax record (which is a public information) promptly showing sale date on 12/21/10, but without any positive outcome. Bank of America states that there is nothing they can do at this time, because they cannot override their system date, and it is up to my Seller and his CPA how they are going to address the issue.

Maybe I am missing something here (certainly I am not a tax accountant), but isn’t against the law? Bofa received and collected funds from the sale in December 2009, when closing has happened. By changing a closing date in their system (intentionally or not intentionally) Bofa has violated IRS rules.

I appreciate any input on if someone may have a piece of advice.

STEP 1 – DEFINE NEEDS
Write down all the reasons for selling your home. Ask yourself, „Why do I want to sell and what do I expect to accomplish with the sale?“

STEP 2 – PRICING STRATEGY
Your next objective should be determine the best possible selling price for your house. You will need to take into account the state of the local market, the condition of your home and sales of comparable homes in your neighborhood. It is often hard to maintain a non-biased view of your property, so you will want to gather the necessary information in the most objective way possible. If you want a truly objective opinion about the price of your home you could have an appraisal done. This may cost between $300-$500. Be reasonable about the price you set. You will always be better off setting a fair market value price than setting your price too high. If your home stays on the market too long because it is overpriced, potential buyers may think that something is wrong with it and you may end up selling it for less than what you could have gotten if you had started out with a realistic asking price.

STEP 3 – PREPARE YOUR HOME
Get your home in „showing and selling“ condition. First impressions are the most important. Work with your real estate agent to help you take a fresh look at your home.

Organize your closets and kitchen cabinets

Make sure items stored in the attic or basement are tidy

Open the curtains or blinds during the day to maximize the natural light

Turn on the lights at night to create a welcoming environment for prospective buyers

A home with too much „personality“ is harder to sell. Consider painting walls white/neutral color, remove clutter. This will help the buyer to visualize the home as theirs

STEP 4 – MARKETING STRATEGY
Now that your home is ready, it’s time to put it up for sale and market it. Establishing a marketing strategy with your real estate agent is a must. Your agent will expose your home to the greatest number of potential buyers possible. He or she will use a marketing plan that will bring not only the most buyers, but also most qualified buyers to your doorstep. You and your agent should structure your marketing strategy so that the first 3-6 weeks that your house is on the market will be the busiest.

STEP 5 – RECEIVE AN OFFER
When you receive a written offer, your real estate agent will advise you as to whatever or not the prospective buyer is qualified to purchase your home. After determining the buyer’s qualifications, you and your agent will review the written contract, taking care to understand what is required of both parties to execute the transaction. The contract should protect the interests of all parties.

STEP 6 - NEGOTIATE TO SELL
Most offers to purchase your home will require some negotiating to come to win-win agreement. Your real estate agent is well versed on the intricacies of the contracts used in your area and will protect your best interest throughout the bargaining. Your agent will review the written offer with you to make sure you thorougly understand what the buyers are offering and what they are asking you for in return.
Once both parties have agreed on the terms of the sale, your agent will prepare a contract. Remember...bargaining is not a winner-take-all deal. It is a business process that involves compromise and mutual respect.

STEP 7 – OTHER NEGOTIATIONS
Once you accept an offer to sell your house you will need to make a list of all the things you and your buyer must do before closing.

STEP 8 – PRE-CLOSE PREPARATION
A few days before the closing you will want to contact the entity that is closing the transaction and make sure the necessery documents are goiing to be ready to sign on the appropriate date.

STEP 10 – CLOSING
„Closing“ refers to the meeting where ownership of the property is legally transfered to the buyer. Your agent will be present during the closing to help explain the process and forms to you and make sure everything goes as planned. Be sure to read all the documents and ask questions. It is important you understand every document you are signing.

Congratulations on the successful sale of your home! Now that you have closed, prepare to vacate your home in the time frame agree upon.

Is there deficiency judgment after foreclosure?

When a mortgage company-Lender- forecloses upon a house, more than likely, it will turn around and sell the house to recover any money owed by the previous homeowner. This amount includes the prior mortgage balance, lawyer’s fees, late payment fees and administrative expense acquired during the foreclosure process. In many cases, in today’s real estate market situation, a lender is able to sell the property at a portion of the cost. The consequence is that the lender losses money on the transaction.
For example, a lender loans a borrower $300,000 to buy a house. 1 year later, the homeowner fails to make the payments and the lender is forced to foreclose. When lender sells the property, it is only able to sell it for $250,00. This results in a $50,000 loss to the lender plus all the fees mentioned above.

In some states, the lender may be entitled to receive the deficiency judgment in court for the remaining balance owed. This means that the lender could sue the home owner for $50,000 loss, that lender incurred. Not in Arizona though. There are some limitations written in State laws: "anti-deficiency" statutes prevent a lender from suing a person for any losses on a home after foreclosure.

Arizona Anti-Deficiency Law says if home is secured with Deed of Trust and sold at Trustee’s Sale no action may be maintain to recover deficiency if:

The property is 2.5 acres or less

Used for single family or two family dwelling

Sold pursuant to the Trustee's power of sale.

The only exceptions to Arizona’s anti-deficiency statutes are VA loans.
If a lender seeks a deficiency judgment, it has 90 days after the sale of the property to begin judicial proceedings to recover.

New mortgage fraud by big banks

In order for a short sale with two loans to happen, the second lien holder has to drop the lien.

If they don’t, and there’s no short sale, the home goes to foreclosure and the first lien holder gets the house because second liens are subordinated debt to the primary loan.

In short, the second lien holder gets nothing. In order to get the second lien holder to drop the lien, the first lien holder generally negotiates some partial payment to the second lien holder. The second lien holder doesn’t have to agree, but more and more are doing so.

That’s all legal.

But here’s what’s not legal and what’s apparently happening quite often recently. Since many second lien holders are getting very little, they are now allegedly requesting money on the side from either real estate agents or the buyers in the short sale. On the side means in cash, off the HUD settlement statements, so the first lien holder doesn’t see it.

And some agents are doing it to get the transaction closed, with probably very little awareness that is a RESPA violation.

RESPA is the Real Estate Settlement Procedures Act, the 2008 law requiring that consumers receive disclosures at various times in the transaction. It outlaws kickbacks that increase the cost of settlement services. RESPA is a HUD consumer protection statute designed to help homebuyers be better shoppers in the home buying process, and is enforced by HUD.

Is it MORAL to Walk Away From Your Mortgage?

The answer to this should be very simple but actually there is no universal response. Is there the morality involved at all? The mortgage industry is doing everything it can to stop this, including telling homeowners that they have a "moral obligation" to re-pay their mortgage.

Lenders to protect their money, require pledging the house as collateral. As a result of borrower defaulting on payment, the Lender has a right to seize the house. It is spell out in the Contract/Promissory Note: if you stop paying, bank gets the house back. Pretty simple.

Lender and borrower made a business decision. Lender concluded that was a smart investment to loan 125% of the value to make a profit. Borrower took a risk to buy a house counting on instant equity. Well, it turned out that both parties of the transaction made a bad business decision.

Many borrowers ask the lender for solution before they decide to walk away. They cannot afford payment for a reason. Either loan needs to be restructured, or principle balance reduced, or rent it back, or something. And then, if the lender says no and… no, then here you go - take the collateral.

In some states banks have recourse; lenders can go after personal asset, so that could be dangerous. But is that OK? Again, banks made a business decision while loaning the money. Why are borrowers held to a higher standards then banks?

Another issue: is it immoral to stop making payments on the mortgage? In most of the cases banks do not even talk to borrower unless he is 3 months behind. Otherwise you are not a priority. Call back when you late on the payment, then bank may notice the issue.

Is it okay to walk away from the mortgage for no other reason that it doesn't make financial sense? Did financial institutions approach anything from a moral standpoint?

Some opinions state: “There is no moral issue as long as the contract is legally addressed.

Morality cannot be legislated or made a clause in a contract. If the lender thought at the beginning that you had a "moral obligation to pay," it would have specified that in the contract”.

I am not an advocate for any solutions but certainly this question is being asked more often by troubled homeowners. And many times leaves me speechless.

Frequently banks utilize as a form of loan modification a trial period that allows temporarily reduce monthly payment for set numbers of months’ to make sure that income is still in place, before program could be implemented permanently.
Banks explain that modified payment during the trial period is going to show up as a rolling 30 day late payment on credit.

The rolling 30 day late payments will have a serious negative impact to Fico scores. More than likely mortgage will show up as being 30 days past due for 4 straight months. This is a great illustration of the disconnect between these mortgage relief plans and the realities of credit reporting.

Supposedly, the federal program requires three trial payments (in some cases four) before the loan can be modified. The reason that it would be considered delinquent on current mortgage is that the payment is lower than originally agreed on the Note. Therefore, it will show as a rolling delinquency on the payments of the difference between old mortgage payment and new mortgage payment the first month, and then when the next trial payment is submitted, the delinquency would be made up but I would have a new delinquency in the second month, and so on, until the loan is modified.
The lender said that "Treasury Guidelines" do not allow the lender to waive the negative credit reporting.

After the terms are met, payment are made on time and modification moves to the permanent status the delinquencies showing on credit bureaus are being wiped out.

So far, I have heard about employers checking profiles, comments, pictures and any available content of their applicants.
Recently, I came across an article written by Erica Sandberg. She is stating that everything you and those in your network do and discuss online may be compiled and provided to creditors. Of course, if your settings are tuned to public. This includes your Facebook status updates, Twitter "tweets," joining online clubs, linking a Web site, and even posting comments on a news blog. Since you are desired to be found by as many potential customers as possible you keep your profile public.

Some Financial Institution access the information that you and your friends reveal online. Watch your behavior patterns - what you like and dislike, want and don't want, do well and do poorly. They gather all your social networking transmission in hope to help them identifying good credit customers and promote certain products.
Another reason - is lowering lending risk. Creditors are able to look how people in your network are handling accounts. If they are responsible cardholders or not. There is a better chance you will be too.

Hike in Picketpost Mountain, Arizona, Phoenix Metro Area

Like almost every Sunday ( at least till the summer) we took a trip to enjoy a beutiful views during the hike. This time we picked the Picketpost Mountain. A quick overview about the area:

Picketpost Mountain is located just outside the town of Superior, Arizona approximately 40 miles (64 km) east of the Phoenix Metro Area. The mountain is located in the southern desert region of Tonto National Forest and is popular with hikers. The mountain is also well-known for an oddly placed mailbox at the top of the mountain, which contains the log books for the Picketpost Mountain Trail.

The mountain’s unusual name stems from an early military camp founded at the base of the mountain by General George Stoneman in 1870. The soldier’s nicknamed the mountain “Picket Post” due to its usage as a sentinel point to guard their camp from attacks. This military camp eventually grew into the present day town of Superior. $8,000 First-time Home Buyer Tax Credit at a Glance

The $8,000 tax credit is for first-time home buyers only. For the tax credit program, the IRS defines a first-time home buyer as someone who has not owned a principal residence during the three-year period prior to the purchase.
The tax credit does not have to be repaid.
The tax credit is equal to 10 percent of the home’s purchase price up to a maximum of $8,000.
The tax credit applies only to homes priced at $800,000 or less.
The tax credit now applies to sales occurring on or after January 1, 2009 and on or before April 30, 2010. However, in cases where a binding sales contract is signed by April 30, 2010, a home purchase completed by June 30, 2010 will qualify.
For homes purchased on or after January 1, 2009 and on or before November 6, 2009, the income limits are $75,000 for single taxpayers and $150,000 for married couples filing jointly.
For homes purchased after November 6, 2009 and on or before April 30, 2010, single taxpayers with incomes up to $125,000 and married couples with incomes up to $225,000 qualify for the full tax credit.

The $6,500 Move-Up / Repeat Home Buyer Tax Credit at a Glance

To be eligible to claim the tax credit, buyers must have owned and lived in their previous home for five consecutive years out of the last eight years.
The tax credit does not have to be repaid.

Realtors See a Decade of Dramatic Developments

—At the beginning of the 21st century, most home buyers had never viewed a home online; the three top home sale marketing methods were yard signs, newspaper ads and open houses; and nearly nine out of 10 buyers financed their purchase with a fixed-rate, 30-year mortgage. What a difference a decade makes.

“The real estate industry has seen tremendous change and evolution over the past decade,” said NAR President Vicki Cox Golder, owner of Vicki L. Cox & Associates in Tucson, Ariz. “As the first, best source for real estate information, Realtors have not only anticipated and adapted to the evolving needs of their clients and customers, but also have influenced industry trends and innovations that will carry us into the future.”

In 1999, buyers who went online in search for a home were in the minority–only 37% of buyers used the Internet in their home search, according to data from the NAR Profile of Home Buyers and Sellers. Today, 90% of buyers are searching online, and the real estate industry has responded. Sites like REALTOR.com, which attracts nearly 12 million total visits every month, have evolved to give today’s buyers what they want–not just property listings, but multiple photos, online videos, mapping features, and comprehensive neighborhood information, as well.

Median home values over the past decade have increased more than 25%, from $137,600 in November 1999 to $172,600 in November 2009 (the most recent existing-home data available). Fewer people are buying detached, single family homes–82% in 1999 compared to 78% in 2009–but more people are buying homes in suburban neighborhoods–46% in 1999 compared to 54% today.

Buyers themselves have also changed. A smaller proportion of married couples are buying homes these days; while married couples comprised 68% of all home purchases at the beginning of this century, they represent 60% of all buyers today. Single men and women have made up the difference–single men purchased 10% of all homes last year, compared to only 7% 10 years ago. Single women now represent more than one-fifth of all home buyers–21% up from 15% in 1999.

Other things haven’t changed. The median age for home buyers last year was 39, just as it was in 1999. Neighborhood quality, affordability, and convenience to work and school have consistently been top priorities for both past and present buyers. And eight out of 10 recently surveyed consumers believe that owning a home is an investment in their future.

“Realtors have been around for more than 100 years, but one constant during that time has been the persistence of homeownership as the American Dream,” said Golder. “As the first decade of this century comes to a close, NAR stands ready to meet the many challenges and opportunities that lie ahead by helping our Realtor members better serve their clients and communities and ensuring that those dreams of homeownership remain possible for all who want to achieve it.”

As of the end of December, 2009.

Total SFD sales for the year will be about 93,000 the 3rd best year on record behind 2004 and 2005, and 55% higher than the 60,108 of 2008.
Sales of December 2009 with 7573 are 55% higher than December of 2008 which had 4873.
At the end of 2009 we have a 3 1/2 month supply of homes compared to an 8 3/4 month supply at the end of 2008.
We currently have 26,169 homes for sale compared to 43048 at the end of 2008.
With increased sales volume came stabilized and improving pricing as we hit the low median price of $115,500 in April, and improved to $130,000 in November, a 12.5% jump. This stabilizing was mostly in the lower price ranges.
There is still no solution for Jumbo Financing which continues to affect price stability of the $500K and up market.
However, the luxury market of Paradise Valley finished the year strong with 34 closes in the month of December and about a one year supply of homes. This compares to the Scottsdale $1M+ supply of about 2 years.

The comparison of current active listing change is based on the previous reports' inventory. Supply numbers are based on the number of closings in the previous month, divided in to the total number of active listings. This data is for Single Family Detached homes only and does not include patio homes, condos, or town homes.

Gilbert named safest community in Arizona

Gilbert was named the safest municipality in Arizona in an annual national report released in November. The report found Gilbert to be 24th safest community in entire United States.

The study analyzes rates and trends for total crime among cities of 75,000 or larger populations.
Gilbert recently surpassed 220,000 population mark, and has long been known for maintaining its safe, family-friendly environment.

In this year’s annual Heads of Households Survey, 97 percent of residents expressed satisfactions with the Town of Gilbert.

The most common reasons cited were:
the Town’s small-town atmosphere
family-friendly focus
clean and safe neighborhoods
friendly people
good retail options
good public schools
good parks and recreation programs.

Residents this year also engaged at high rate in block parties, which give neighbors a chance to get to know each other and plan a block watch program that can help keep communities safe.

FHA LOAN LIMITS FOR 2010 – IMPORTANT!!

In February 2009, the Government increased the FHA Loan Limits in the American Recovery and Reinvestment Act of 2009 (ARRA). Those limits are only in effect until December 31, 2009. Today, HUD announced the New FHA Loan Limits for 2010.

The new Maximum FHA Loan Limit in Maricopa County will be LOWERED from $346,250 down to $271,050 for Single Family Residences effective January 2010.

For a majority of the state of Arizona, the FHA loan limits will be as follows:

One-Unit - $271,050
Two-Unit - $347,000
Three-Unit - $419,400
Four-Unit - $521,250

Loans must be Approved by December 31^st in order to use the higher loan amounts before they expire.

What this means is that people that are buying a home in the range between $271,050 and $346.250 will need to pay more money for a down payment, risk paying higher monthly Private Mortgage Insurance premiums if they do not have a 20% down payment , and have potentially higher interest rates based on their credit scores if using Conventional financing. If you are representing a buyer that is looking in this price range it is of the utmost importance that they are aware of this new information. If you are working with a seller they must also understand that this information can greatly reduce the number of people that will be able to buy their home without a substantial amount of money for a down payment.

Ironically, $271,050 (the new limit) is 78.3% of the old limit $346,250.

I visit many homes after Trustee Sale with interested Buyers and wonder at what I might find indoors when I put the key into the lock. The last foreclosed home I toured had exceeded my expectation and imagination. I have seen a lot properties with missing:

1. Appliances such as stoves, built-in microwaves, dishwashers, etc.
2. Flooring tiles, parts of carpet
3. Kitchen Islands (ripped off from the middle of the kitchen)
4. Cabinets and counter tops
5. Light fixtures and ceiling fans, doors and hardware
6. Toilets, bath tubs and sinks
7. Furnaces and air conditioning units (A/C units are very popular)
8. Landscaping- trees, shrubs, bushes, bricks
9. ETC, ETC

When homeowners do leave their property, they do not always simply "walk away." Do they?

So, after a while I got used to it. Just warned my buyers what they can expect inside foreclosed properties.

What was done to home I went to recently in Maricopa, AZ just shocked me.

The homeowner must have been so furious and ready to take on the structure he lived in for at least few years. Inside the house we discovered purred CONCRETE into the toilet and bath drainage!!!! What a courage... to get the material and pay for it, invest a time and effort to prepare the mixture and fill in the drainage! GOAL achieved! The foundation must be ripped off and the entire drain pipes replaced. House do not qualify as livable (at least not up to FHA standardsJ)

Homeowner was probably having a bad day.

Some misguided home owners, angry at the bank for foreclosing, think it's somehow permissible to turn the home into a total nightmare. It is ILLEGAL. Banks are most likely to pursue and prosecute homeowners who vandalize or strip their homes while in foreclosure.

But does it really happen? Personally, I have not heard of any legal action against homeowner who stripped or demolish his house while in foreclosure.

Ethics in SHORT SALE process. Is there any????

Every new market condition creates new challenges for the realtors.

Buyers should disclose that are making multiple offers to the seller, because that my affect Seller's choice. But where? Is there any form approved by Department of Real Estate in any states?

There are debates if any action could be brought against the buyer making multiple offers on properties without full disclosure to the sellers for "lack of good faith". And for real estate agent representing the buyers for misleading information and manipulating the seller's decision of acceptance, according to a Code of Ethics.

How do we justify that? Agents representing buyers have a difficult time getting an offer accepted. Is it ethical for the Lender/Bank have no response for months? Certainly, it is ethical to a Seller, for whom the offer might the last chance to avoid foreclosure.

So, should you submit multiple offers on properties?

Every situation is different, and there are no blanket answers for a question like this. In the metro Phoenix area market, if you are interested in buying a short sale or foreclosure, you almost must submit multiple offers. It is not uncommon to submit an offer, and wait 10, 20, or more weeks to get an answer that lender/investor decided to reject the offer and foreclose anyway, so you are left off with angry buyer starting the process all over again. And buyer just want to buy a house, without waiting for months. It almost makes sense to secure offers on multiple properties and hope that at least one go through.

Without proper regulations and guidelines, the perception of today's market conditions is so puzzled, that is almost frightening to ask for correct answers. You put yourself at risk to receive to many different opinions.

Overall, I think that we have an obligation to a higher standards and the actions we take on behalf of our clients can never override our obligation to the Code of Ethics.

In this market – and possibly this very moment – sellers across the country are
asking themselves one question: why isn’t my home selling?
While each client’s situation is unique, and we all think our homes are special, there is one underlying factor that makes or breaks a buyer’s decision to settle on your home: PRICE.

Pricing your home correctly in this market is one of the most critical actions you can take to sell your home faster – it's also one of the most difficult decisions you’ll have to make as a seller. Which is why so many people won’t do it. What sellers have to realize is that by making the decision to price correctly from the beginning they may be staving off further financial damage. For some, that means getting creative about finances, for others, it can sometimes translate to taking a small loss. In some cases, taking a small loss may be the best scenario.

Let’s look at it another way.

John Seller paid $300,000 on his home that is now worth $250,000. Many REALTORS® would tell him to come down on his price at the beginning by say, $20,000.
Now his asking price is $280,000.
Scenario (1):
A buyer comes along after one month on the market. They know, based on the CMA, that Mr. Seller’s house is worth $250,000, so they put in an offer for $245,000. Mr. Seller decides to counter with $255,000, and SOLD! Now Mr. Seller can move on knowing that he is lucky not to have lost any more on his home.
Now Scenario (2):
Mr. Seller actually decides not to come down on his price at all. As a result his home sits on the market for the first month with only a few bites from buyers but no official offers. An experienced REALTOR® would recommend that Mr. Seller come down 10 percent each month that his home doesn’t sell. He does it. Two months later Mr. Seller’s home is now at $243,000. Finally, in the third month, a buyer comes along and offers $237,000. At this point Mr. Seller is considering, but feels it’s too low, so his home sits another month. Frustrated, Mr. Seller decides not to come down on his price anymore. At this point Mr. Seller is in trouble. He is underwater on his mortgage and every additional dollar he loses on the home sale must come out of his pocket to pay off the loan. By starting at a higher value than the market will support, he stands to lose more than if he had factored in a small loss up front.

These two scenarios demonstrate the increasingly critical point of pricing your home correctly from the moment you decide to sell. While it may seem exaggerated, there truly are sellers experiencing situations similar to the ones described above. The good news is that by teaming up with an experienced real estate agent, who knows your market well, you have a far greater chance of making informed decisions about the price of your home. Your REALTOR® wants you to get the most money possible out of the sale of your home – and these days – that means reducing FROM THE START.

Phoenix, Arizona - Houses Bidding wars ONE MORE TIME!

Do we want to live bidding wars again? Do we actually have a choice?

Hanna and I practice real estate in Metro Phoenix AZ, heavily in East Valley Cities.
It is crazy out there! Tougher and tougher to "win" a property for a buyer.

First, finding a property that is an a good shape- with REO it is already a challenge. If one is found, there are multiple offers placed on the first day on the market. Trying to outbid the price 10-20% knowing exactly, that property will not appraise for offered amount! Explaining the strategy to the buyer that is being implemented just to get in the door. Next, waiting time to receive executed contract back from
the lender (sometimes 14 days or longer). You still not sure if you have the property tied up in or not, neither your buyer. Finally, appraisal came in low...what a bummer... Re-negotiating the terms with the lender again. By now, escrow is extended for 60 days or more. Finally, you are ready to close and just waiting for Title to be done. And waiting...

Second, the short sale bidding process. Competing against other bidders, having no idea if bank will even consider the price. If you buyer's offer gets chosen and offer is accepted by the seller, the waiting process starts there. To receive approval (or denial) from the lender/bank may take several weeks. So, eventually you may raise against nothing.

Third, "regular" sales by individuals that actually own the house and could sell on their terms. It seems like it is a sellers' market again, so multiple offers are very welcomed. Your seller will love you for bringing more than one offer to the table. It is great to be a listing agent in that position.

To survive a bidding wars again, we have to consider: buyer comfort zone, knowing the value of the property, and not letting emotion to drive a buying decision even though, buying a house is an EMOTIONAL process.

Fail to prepare, prepare to fail -Tax Credit Extension

Our economy still needs a booster. The great way is to keep the tax credit (or increase it to $15,000) for 2009.

Again, not only for first time home buyers, for any home buyer that is willing to live in the property. New home builders are excited with statistics on home sales being up for last 3 months, inventory is down and demand is positive. They are not too enthusiastic about time running out. New constructions cannot be finished by the due date-November 30.

The National Association of Realtors said earlier this month that the credit has already brought 1.2 million new buyers into the market, including 350,000 buyers who would not have purchased a home without the credit.

Obama administration has been approached to evaluate the Tax Extension for 2009. The benefits may out scale the expectations. However, many say that housing recovery is the icing on a cake not the cake itself.

Tax Credit for first time Home Buyers, September Newsletter

With low interest rates, a large inventory of homes, and decreasing home prices, there’s never been a better opportunity for first-time homebuyers, who are financially able, to purchase a home. In fact, the National Associates of REALTORS® predicted 53.5% of homebuyers in 2009 will be first-timers; due in most part to the $8,000 tax credit. But who qualifies as a “first-time homebuyer” and what are the exact provisions surrounding the tax credit? Keep reading for a short FAQ and find out why you need to act now if you plan on taking advantage of this great government incentive!

1. Who exactly qualifies as a first-time homebuyer?
The law defines "first-time home buyer" as a buyer who has not owned a principal residence during the three-year period prior to the purchase. For married taxpayers, the law tests the homeownership history of both the home buyer and his/her spouse.

2. How is the amount of the tax credit determined?
The tax credit is equal to 10 percent of the home’s purchase price up to a maximum of $8,000.

3. Are there any income limits for claiming the tax credit?
Yes. The income limit for single taxpayers is $75,000; the limit is $150,000 for married taxpayers filing a joint return.

4. How is this home buyer tax credit different from the tax credit that Congress enacted in July of 2008?
The most significant difference is that this tax credit does not have to be repaid. Because it had to be repaid, the previous "credit" was essentially an interest-free loan. This tax incentive is a true tax credit. However, home buyers must use the residence as a principal residence for at least three years or face recapture of the tax credit amount. Certain exceptions apply.

5. How do I claim the tax credit? Do I need to complete a form or application?
Participating in the tax credit program is easy. You claim the tax credit on your federal income tax return. Specifically, home buyers should complete IRS Form 5405 to determine their tax credit amount, and then claim this amount on line 67 of the 1040 income tax form for 2009 returns (line 69 of the 1040 income tax form for 2008 returns).

6. What types of homes will qualify for the tax credit?
Any home that will be used as a principal residence will qualify for the credit. This includes single-family detached homes, attached homes like townhouses and condominiums, manufactured homes (also known as mobile homes) and houseboats. The definition of principal residence is identical to the one used to determine whether you may qualify for the $250,000 / $500,000 capital gain tax exclusion for principal residences.

7. I heard that some buyers are eligible to use the loan toward closing costs, is this true?
Yes. Buyers applying for FHA-backed financing with an FHA-approved lender that offers a bridge-loan program can get a bridge loan to bring down the upfront costs of buying a home. Though, these same buyers will still have to come up with the minimum 3.5 percent down payment.

We are "Brand New Bloggers" trying to read other blogs and educate ourselves how to do it, what to write on, how long the post supposed to be. Also, most importantly, how often and what content to post to start to be visible.

That is the purpose everyone is writing about: creating traffic to the website and receive leads. Does the content really matter? Does it have to be about real estate mainly? Otherwise potential prospect will not take you seriously if you write about your family, dog or what is being made for dinner today? Statistically, how many posts a week is desired to start to be effective. Any rules in general? Is blogging on other websites is as effective or more/less than on active rain? No matter what age you are. If you have a problem ask your kids. They are the best resource.

The world became global village, you need to be find virtually. The wind of changes is faster than we have expected, but how to keep it up? Enough to do during the day, what we have been doing already! And now we are being told it is not enough. Traditional marketing real estate channels are fading out (in my opinion). I wish I had a crystal bowl. Anywhere you look a different prediction in regards to our economy: good and bad... bottom out... not yet... maybe 2009... maybe 201... maybe never....
As a realtor I am being asked always the same question: do you think market is going to go down even farther? Is this community holds its value pretty well? Will it? Maybe it is not a good time to buy yet. I know, we talk about this over and over again. How to approach the concerns.
I wish someone would come up with universal answer for the time being. That would make our job easier. And I am not asking for sale speech or motivation dialogue we have at training meetings. Something real...
